1. Create a Trust with a Co-Trustee Who Can Stay in the U.S.
Set up a Living Trust and name a Co-Trustee who has permanent legal status in the U.S. Make sure your assets — like your home and bank accounts — are properly titled in the name of the Trust. For example: “Martha Patterson and [Friend’s Name], as Trustees of the Martha Patterson Trust.”
2. Plan for Your Children’s Safety
If you have minor children, it’s crucial to have a plan in case you are deported or become unavailable. An adult will need to file for legal guardianship in court. This process requires official court documents called “Letters of Guardianship.” Informal documents or notarized letters won’t be enough — only a court order gives someone the legal authority to care for your child.
3. Be Careful Who You Trust for Legal Help
If you are undocumented, do not hire someone who is not a licensed attorney. Only attorneys can represent you in court. Unfortunately, many non-lawyers charge for legal services they’re not qualified to provide, and you may have no legal recourse if they take your money and disappear.
